Definitions

• "User," "you," or "Customer" means any individual or entity that accesses mobec.io or uses the Services.
• "Portable Charger" means Mobec Innovation Private Limited's mobile EV charging unit dispatched to a Customer's location on request.
• "ESS" means Mobec Innovation Private Limited's energy storage system products, including the Gen Set and HomeZ product lines.
• "Platform" means the mobec.io website and any associated mobile application used to request, schedule, or manage Services.
• "Content" means text, graphics, logos, product data, and other material made available on the Platform.

Eligibility & Account Registration

• You must be at least 18 years old and capable of entering into a binding contract under the Indian Contract Act, 1872, to use the Services.
• Certain features (e.g., scheduling a Portable Charger, purchasing an ESS product) require you to create an account and provide accurate, current, and complete information, including a valid mobile number and vehicle or property details as applicable.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at the contact details in Section 17 if you suspect unauthorized use.
• Mobec Innovation Private Limited reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

Description of Services

Mobec Innovation Private Limited provides the following, subject to availability in your service area:

• On-demand and scheduled portable EV charging delivered to a location specified by the Customer.
• Sale, installation guidance, and support for home and commercial energy storage systems.
• Battery collection, recovery, and recycling programs for eligible battery types.

Service availability, charger capacity, estimated arrival times, and product specifications are provided on a best-effort basis and may vary due to demand, location, traffic, weather, or grid conditions. Mobec Innovation Private Limited does not guarantee uninterrupted or error-free availability of any Service.

Booking, Fulfilment & Cancellation

• Charging sessions and product orders may be requested through the Platform. A booking is confirmed only upon receipt of confirmation from Mobec Innovation Private Limited.
• You must ensure safe and lawful access to the charging location, including compliance with any applicable parking, building, or society rules.
• Cancellations made after a Portable Charger has been dispatched may incur a dispatch or convenience fee, disclosed to you at the time of booking.
• Mobec Innovation Private Limited may reschedule or decline a booking due to safety concerns, vehicle incompatibility, unsafe access conditions, or circumstances beyond our reasonable control.

Pricing & Payment

• Prices for charging sessions, ESS products, and related services are displayed on the Platform at the time of booking or purchase and are subject to change without prior notice, except for orders already confirmed.
• All payments must be made through the payment methods supported on the Platform. You authorize Mobec Innovation Private Limited and its payment processors to charge the applicable fees.
• Applicable taxes, including GST, will be added to the listed price where required by law.
• Refunds, where applicable, will be processed in accordance with Mobec Innovation Private Limited's refund policy, which may be published separately on the Platform.

Product Warranty & Battery Recycling

• ESS products and Portable Charger equipment are covered by any written warranty provided at the time of purchase. Except as expressly stated in that warranty, all products are provided on an "as is, as available" basis.
• Batteries submitted through Mobec Innovation Private Limited's recycling program are accepted subject to inspection and Mobec Innovation Private Limited's then-current recycling guidelines. Mobec Innovation Private Limited reserves the right to refuse batteries that are damaged, unsafe, or not covered by the program.
• You represent that any battery or equipment submitted for recycling is lawfully owned or controlled by you and free of undisclosed hazards.

User Obligations & Prohibited Conduct

When using the Services, you agree not to:

• Provide false, misleading, or incomplete information when booking a Service or creating an account.
• Use the Platform or Services for any unlawful, fraudulent, or unauthorized purpose.
• Interfere with, damage, or attempt unauthorized access to Mobec Innovation Private Limited's charging equipment, ESS units, Platform, or systems.
• Resell, sublicense, or commercially exploit the Services without Mobec Innovation Private Limited's prior written consent.
• Copy, modify, reverse-engineer, or create derivative works from the Platform or its Content.

Intellectual Property

All Content on mobec.io, including the Mobec Innovation Private Limited name, logo, trademarks, product designs, software, and website design, is the property of Mobec Innovation Private Limited or its licensors and is protected under applicable intellectual property laws. Nothing in these Terms grants you any right to use Mobec Innovation Private Limited's trademarks or branding without prior written permission.

Third-Party Services & Links

The Platform may contain links to or integrations with third-party services (e.g., payment gateways, mapping services). Mobec Innovation Private Limited does not control and is not responsible for the content, policies, or practices of any third party. Your use of third-party services is at your own risk and subject to their respective terms.

Limitation Of Liability

To the maximum extent permitted by applicable law, Mobec Innovation Private Limited, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or vehicle downtime, arising out of or related to your use of, or inability to use, the Services. Mobec Innovation Private Limited's total aggregate liability arising from these Terms or the Services shall not exceed the amount paid by you for the specific Service giving rise to the claim in the preceding three (3) months.

Indemnification

You agree to indemnify and hold harmless Mobec Innovation Private Limited, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your breach of these Terms, misuse of the Services, or violation of any law or third-party right.

Privacy

Your use of the Services is also governed by Mobec Innovation Private Limited's Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Services, you consent to such collection and use in accordance with the Privacy Policy.

Suspension & Termination

Mobec Innovation Private Limited may suspend or terminate your access to the Platform or Services, with or without notice, if you breach these Terms, engage in fraudulent or unsafe conduct, or for operational or legal reasons. You may stop using the Services and close your account at any time by contacting us.

Governing Law & Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
• Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved amicably. Failing amicable resolution, disputes shall be subject to arbitration under the Arbitration and Conciliation Act, 1996, seated in [City], India, with proceedings conducted in English.
• Subject to the arbitration agreement above, the courts at [City], India shall have exclusive jurisdiction.

Force Majeure

Mobec Innovation Private Limited shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, power or grid failures, government action, strikes, or telecommunications or internet outages.

Changes to These Terms

Mobec Innovation Private Limited may update these Terms from time to time. Material changes will be notified via the Platform or by email. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
